Welcome to CardLinko! These Terms of Service ("Terms") govern your access to and use of the CardLinko website, applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
Please read these Terms carefully as they constitute a legally binding agreement between you and CardLinko ("we," "our," or "us").

To use certain features of the Services, you must register for an account. When you register for an account, you must provide accurate and complete information. You are responsible for safeguarding your account password and for any activities or actions under your account.

CardLinko provides digital business card creation and management services, allowing Users to create, customize, and share digital business cards.
Some of our Services are offered for a fee. By choosing a paid Service, you agree to pay the applicable fees as they become due. All fees are non-refundable unless otherwise stated or required by applicable law.
If you purchase a subscription, it will automatically renew at the end of each subscription period unless you cancel it prior to the renewal date. You may cancel your subscription at any time through your account settings or by contacting us at support@cardlinko.com.
We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.
You retain all rights in, and are solely responsible for, the User Content you post, upload, publish, submit, or transmit to be made available through the Services.
By making any User Content available through the Services, you grant CardLinko a non-exclusive, transferable, sublicensable, worldwide, royalty-free license to use, copy, modify, create derivative works based upon, distribute, publicly display, publicly perform, and distribute your User Content in connection with operating and providing the Services.
You agree not to post, upload, publish, submit, or transmit any User Content that:

The Services and all Content included in or made available through the Services, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, and software, are the property of CardLinko or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Subject to your compliance with these Terms, CardLinko grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal or business purposes.

You acknowledge and agree that CardLinko shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, CARDLINKO EXPLICITLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARDLINKO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
You agree to defend, indemnify, and hold harmless CardLinko and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your User Content caused damage to a third party.
These Terms shall remain in full force and effect while you use the Services. We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be exclusively brought in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
